Terms of Service

These Terms of Service are an agreement between you and M/S Namshi Enterprises, operating BargainFox (“BargainFox,” “we,” or “us”). By using the BargainFox website, apps, or WhatsApp-based services (the “Service”), you agree to these terms.

Eligibility and accounts

You must be at least 18 and able to form a binding contract where you live. Provide accurate information, keep your sign-in and linked WhatsApp access secure, and promptly review unexpected account activity. You are responsible for actions taken through your account.

What BargainFox does

BargainFox helps you describe a local service need, discover independent providers, request and negotiate offers, compare results, and communicate an approved choice. The Service uses automated systems and AI. Features may be unavailable in some locations or for some service categories.

Negotiations and approval

You may provide a maximum price to guide a negotiation. BargainFox is designed not to disclose that ceiling to vendors, not to offer above it, and not to make a booking or payment commitment before you approve an offer. You remain responsible for checking the provider, scope, price, timing, and conditions before approval.

After approval, BargainFox may tell the selected vendor that you accept and may close conversations with other vendors. An approval sent through your account is treated as your instruction. If a quote changes, expires, or no longer matches the presented details, confirm the final terms directly with the vendor.

Independent vendors

Vendors are independent businesses, not employees, agents, or partners of BargainFox. We do not control or guarantee their identity, licensing, insurance, availability, pricing, communications, workmanship, safety, or performance. Any service contract is between you and the selected vendor. Perform any checks appropriate for the job before allowing access to property or making payment.

Your responsibilities

You must provide lawful and reasonably accurate job information, have authority to request the work, respond when a vendor needs a decision, and use the Service only for legitimate local-service discovery and negotiation. Do not ask BargainFox to conceal material job facts, misrepresent your identity, or commit to terms you do not intend to honor.

Acceptable use

You may not use the Service to break the law; harass, threaten, defraud, or spam anyone; seek prohibited goods or services; access accounts or data without permission; distribute malware; interfere with the Service; evade safeguards or usage limits; expose another person’s private information without authority; or violate WhatsApp, provider, or connected-service terms.

WhatsApp and third-party services

The Service may rely on WhatsApp, Meta, search and mapping tools, AI model providers, computer providers, and hosting infrastructure. Their terms, availability, limits, and fees may apply. We are not responsible for third-party outages, suspensions, policy changes, or information handled under their independent terms.

Prices and payments

Vendor quotes may exclude taxes, materials, travel, inspection, or work discovered later unless the offer states otherwise. Unless clearly presented in the Service, BargainFox does not collect or settle payment for the vendor’s work; you pay the selected vendor directly under your agreement with that vendor. Any future BargainFox fee will be disclosed before you agree to pay it and may be subject to additional checkout terms.

AI limitations

Automated output can be incomplete, delayed, or wrong. BargainFox may misunderstand a request, miss a provider, or summarize an offer incorrectly. Review important details before relying on them. Do not use the Service for emergencies or where an error could cause death, injury, major property damage, or legal, medical, or financial harm without qualified human review.

Your content

You retain ownership of information you provide. You give us permission to host, process, and transmit it only as reasonably needed to operate, secure, and improve the Service and complete the work you request, as explained in the Privacy Policy. You confirm that you have the right to provide that information.

Cancellation

You can cancel an active BargainFox deal before booking, which stops further negotiation messages. If you already approved a provider, that provider’s cancellation or call-out terms may apply. Cancelling BargainFox does not cancel a separate agreement with a vendor unless the vendor confirms it.

Availability and changes

We may add, change, pause, or remove features and may limit use to protect users, vendors, or the Service. We do not promise uninterrupted or error-free availability. Beta or preview features may change without notice.

Suspension and termination

You may stop using the Service and request account deletion. We may restrict or terminate access if you violate these terms, create risk, misuse connected services, or if required by law. Provisions that should reasonably survive termination—including responsibility for approved transactions, disclaimers, and liability limits—continue to apply.

Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that a vendor, quote, saving, booking, or outcome will meet your expectations. Nothing in these terms removes consumer rights that cannot lawfully be waived.

Limitation of liability

To the extent permitted by law, BargainFox and M/S Namshi Enterprises are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, opportunities, or data; or the acts, omissions, work, charges, or disputes of independent vendors. Our aggregate liability relating to the Service will not exceed the amount you paid directly to BargainFox for the affected Service during the 12 months before the claim. Liability that cannot legally be limited remains unaffected.

Indemnity

To the extent permitted by law, you will be responsible for third-party claims and reasonable related costs arising from information you provide, work you approve, your misuse of the Service, or your violation of these terms or another person’s rights.

Governing law

These terms are governed by the laws of India. Subject to mandatory consumer rights and applicable dispute-resolution requirements, courts in Gautambuddha Nagar, Uttar Pradesh will have jurisdiction.

Changes to these terms

We may update these terms as the Service or law changes. The date at the top identifies the current version. Material changes will be presented through the Service when reasonably required. Continued use after the effective date means you accept the updated terms.
